While Joe Biden has been pushing to codify DACA, a Judge ruled that the program is illegal in a suit brought by Texas Attorney General Ken Paxton along with 7 other states.
The judge in the case ruled that DACA recipients who were approved prior to July 16, 2021 wouldn’t be affected by the ruling and would still be allowed to stay in the United States.
It also states that DHS can still accept applications but can not grant any approvals going forward. The judge noted that this is still an ongoing case and that the ruling is not a final decision.

U.S. District Judge Andrew Hanen also wrote in his decision, “While sympathetic to the predicament of DACA recipients and their families, this Court has expressed its concerns about the legality of the program
