A formal investigation has been launched into former Special Counsel Jack Smith, the man behind both of President Donald Trump’s criminal cases under the Biden Department of Justice.
The Office of Special Counsel (OSC) confirmed the probe this week, marking a major development in the ongoing backlash against what many Republicans have called politically driven lawfare.
Smith led two high-profile investigations into Trump.
The first, regarding classified documents, was thrown out by Judge Aileen Cannon, who ruled Smith’s appointment violated constitutional requirements.
The second, centered on Trump’s 2020 election challenges, was partially dismantled by the Supreme Court’s ruling on presidential immunity. That case collapsed entirely after Trump won re-election in November.
According to an email obtained by the New York Post, the OSC’s Hatch Act Unit is conducting the investigation.
That unit enforces rules banning political activity by federal employees.
The email came from Senior Counsel Charles Baldis and confirmed the agency is formally reviewing Smith’s conduct, Trending Politics reported.
Arkansas Sen. Tom Cotton (R) reacted swiftly. “I appreciate the Office of Special Counsel taking this seriously,” Cotton said. “Jack Smith’s actions were clearly driven to hurt President Trump’s election, and Smith should be held fully accountable.”
